Oh Crap Situation 17: Stolen Ideas

I recently went to a social gathering and saw a guy I used to work with.  We had worked on a site, published it online under everyone’s name, and planned on completing this project.  Lo and behold, this guy drops out - unfortunately, he was the coder!   The idea from the site came from me, so I hold the idea and the expression of them very close.  Unable to find another coder who would work for a minimal salary, the site fades into black.

Well at this gathering, he approaches you and says “Hey, I have something to show you!”  He pulls up a website on his laptop and it is some strange website I had never seen before.  He browses the pages and things begin to look familiar.  As it turns out, this guy stole my idea!  Everything about it is essentially the same!  Each business partner signed a contract with this individual (without a lawyer present to legitimize the contract) and we aren’t sure what to do with it.  How should I approach this idea?  Should I sit around and let someone profit off of my brainchild?  Is it possible to press charges?  How would you approach this?
